This Agreement applies to the reservation shown in the Booking Summary. By selecting Confirm & Reserve, the Member accepts the Booking Summary and these terms.
1. Booking Summary
Before confirmation, Ark shows:
- Vehicle and reservation dates.
- Credit cost and resulting balance.
- 100-mile-per-day allowance and vehicle-specific overage rate.
- Pickup or delivery details.
- Cancellation deadline.
- Temporary card authorization, if applicable.
- Any vehicle-specific restriction or charge.
The confirmed Booking Summary controls that reservation. Ark will not increase the confirmed credit cost without the Member's approval.
2. Payment and credit confirmation
Ark commits the required credits when the reservation is confirmed. If the Member needs more credits, the confirmation screen shows the exact shortage and Extra Credit charge. The Member's single confirmation authorizes the saved card charge, credit addition, and reservation commitment as one transaction.
Extensions require availability and the same affirmative confirmation. Ark does not silently charge Extra Credits or bill them day by day.
3. Driver eligibility and insurance
Only the Member and additional drivers separately approved by Ark may operate the vehicle. Every driver must be at least 21, properly licensed, legally able to drive, and covered by insurance meeting Ark's requirements.
The Member's personal auto insurance is primary unless the Booking Summary expressly states otherwise. The Member remains responsible for charges and losses not paid by insurance, including when coverage is denied or insufficient, subject to applicable law and any damage limit disclosed before confirmation. The Member remains responsible for every approved additional driver's conduct and charges.
4. Pickup, delivery, possession, and return
The Member is responsible for the vehicle from confirmed pickup or delivery until Ark confirms its return.
- Miami-core delivery normally requires 24 hours' notice and remains subject to availability. HQ pickup is the fallback.
- The vehicle must be returned on time, in the agreed location, and at the disclosed starting fuel level.
- Ark and the Member may document the vehicle's condition, mileage, fuel, keys, equipment, and accessories with a check-out/check-in inspection and time-stamped photos. New damage or missing items identified at return may be charged under this Agreement.
- One Member may control one Ark vehicle at a time. Sequential vehicle reservations are allowed.
- A temporary authorization may be placed on the card before vehicle release. The Booking Summary shows the amount.
Personal property left in the vehicle is the Member's responsibility. To the extent permitted by law, Ark is not responsible for loss of or damage to property left in a vehicle, delivery vehicle, or Ark facility.
5. Mileage and additional charges
Each vehicle-day includes 100 miles. Miles pool across consecutive days in the same reservation.
Current overage rates are:
- $5 per mile: G550, G550 Professional, G63, Maybach GLS, Urus, and Cullinan.
- $10 per mile: McLaren GT, 720S, and Sterrato.
The rate shown in the confirmed Booking Summary controls. The Member authorizes Ark to charge the saved payment method for disclosed mileage overage, tolls, tickets, refueling, late return, cleaning beyond normal use, damage, loss, and other amounts incurred under the Booking Summary.
For damage, loss, theft, abandonment, or prohibited use, responsibility may include reasonable repair or replacement cost, diminished value, loss of use while the vehicle is unavailable, missing keys or equipment, towing, storage, recovery, appraisal, claim administration, and collection costs, to the extent permitted by law and not paid by insurance. Ark may apply any temporary authorization or other amounts held to valid charges and will provide an itemized record.
6. Changes and cancellations
- Cancel at least 24 hours before the confirmed start: committed credits return to the account.
- Cancel inside 24 hours or fail to appear: committed credits are forfeited.
- An extension is effective only after Ark confirms availability and required payment or credits.
- If maintenance, safety, or another operational issue makes the vehicle unavailable, Ark may offer a substitute, account credit, or return of committed credits.
7. Vehicle-use rules
The Member must follow applicable law and all vehicle-specific instructions. The following are prohibited:
- Unauthorized drivers, lending, subleasing, or resale.
- Racing, timed competition, stunt driving, unauthorized track use, or exceeding 110 mph.
- Impaired, reckless, illegal, or abusive operation.
- Smoking or vaping.
- Commercial passenger or delivery use, teaching anyone to drive, towing, off-road or unpaved-surface use, or carrying hazardous or illegal materials.
- Sitting or standing on the vehicle, installing or removing equipment without approval, or continuing to drive when a warning or condition indicates further operation may damage the vehicle.
- Disabling telematics, safety, or tracking equipment.
Pets, out-of-state travel, unusual delivery requests, and any use outside the disclosed territory require Ark's advance approval.
8. Damage, accidents, and roadside events
The Member must stop safely, contact emergency services when required, protect the vehicle from further damage, and contact Ark immediately. Accidents, theft, and vandalism must also be reported promptly to law enforcement when required or reasonably requested by Ark. The Member must not admit fault, abandon the vehicle, arrange unauthorized repairs, or conceal an incident.
The Member must provide accurate incident information and reasonably cooperate with Ark, law enforcement, insurers, roadside providers, and claims administrators. Karsten or Dmitry will coordinate Ark's immediate response.
The Member is responsible for the vehicle, keys, accessories, tolls, citations, damage, loss, and loss caused by unauthorized use, subject to applicable insurance, law, and any disclosed damage limit. Ark may recover or repossess a vehicle at the Member's expense if it is abandoned, unlawfully retained, or materially used in violation of this Agreement.
9. Risk and conduct
Driving performance and luxury vehicles involves risk of property damage, injury, and death. The Member voluntarily assumes the ordinary risks of driving and is responsible for the conduct of approved guests and drivers. To the fullest extent permitted by Florida law, the Member releases and indemnifies Ark and its personnel from claims caused by the Member's or guest's conduct, except to the extent caused by Ark's gross negligence or willful misconduct.
Unsafe conduct, fraud, nonpayment, material misrepresentation, or violation of these rules may result in immediate loss of vehicle access and membership suspension or termination.
10. Electronic acceptance
The electronic confirmation, Booking Summary, and this Agreement form the complete record for this reservation. Ark will retain the Agreement version, Booking Summary, Member identity, timestamp, reservation and payment identifiers, and available acceptance evidence.
Required booking acknowledgment
I reviewed this Booking Summary and agree to the credit cost, mileage and overage terms, card authorization, cancellation policy, and Ark Booking and Vehicle Use Agreement. I authorize the confirmed charges and request this reservation.
